Tier 4 dependent right to work

Post by poojadalal0811 » Mon Feb 24, 2020 12:16 am

First of all, apologies if this is not the right forum for this topic.

I'm still waiting for my BRP card but the email I received on application status has below condition -
Remark: “NO WORK NO ENGAGING IN BUSINESS”
As you have been granted leave as the dependant of a Tier 4 (General) Student who has been granted leave for a period of less than 12 months, and/or is following a course of study below degree level, you are prohibited from taking employment or engaging in any business in the United Kingdom.

That means I don't have work rights in the UK.

I believe this condition is incorrect because
A) the visa grant period is more than 24 months
B) my partner's Course title: Master of Business Administration with PG Cert, which is a Level 7 course.
C) my partner is allowed to work for 20 hours as this is a degree course.
Anyone experienced the same issue?

Please suggest ways to rectify this as my job dependents on the same.

Hey poojadalal0811,

Did you manage to sort this issue? Did your brp actually had this remark?
Just got my confirmation email with the same conditions.

Thanks,

Hi all,

Thanks for your response.

Yes, the problem is sorted. Looks like the email sent was a standard email as explains about all the conditions you could have in your brp. In my scenario, the remark wasn't applied on my BRP card. So, all good in the end.

Hello everyone,

My wife and I have been in the UK for about five years under Tier 4 visa and she was a PhD student and I am her dependent. So, I am working full-time in the UK.
Recently, we have applied for Tier 4 Doctorate extension visa which is for 12 months. We have received an email from Home office on Monday and accordingly our applications have been successful. Our new visa is valid for 12 months and course level is higher level of education. But, in my email as a dependent there is three points This points are as follow:
Conditions set out in your BRP
The following explains what the remarks on your BRP mean:

Remark: “NO DR/DEN TRAIN OR SPORTSPERSON”
Employment allowed:

· any work other than the exceptions below, providing it complies with relevant employment laws

Employment not allowed:

· as a doctor or dentist in training

· as a professional sportsperson or sports coach

Remark: “NO WORK AS SPORTSPERSON”
Employment allowed:

· any work other than the exceptions below, providing it complies with relevant employment laws

Employment not allowed:

· as a professional sportsperson or sports coach

Remark: “NO WORK NO ENGAGING IN BUSINESS”
· As you have been granted leave as the dependant of a Tier 4 (General) Student who has been granted leave for a period of less than 12 months, and/or is following a course of study below degree level, you are prohibited from taking employment or engaging in any business in the United Kingdom.

In the meantime, we are waiting for receiving our BPR by TNT.
Regarding the above points especially point three, I am concerned that I can not work anymore.
Is anyone has any idea about this issue.

Hi
many thanks for sharing your experience.

I think my situation is as your situation.

Did you receive all this three remark from Home office? How long did you wait for receiving your BRP by post?
Is only one remark out of these three on your BRP?

I received my BRP card on the 3rd day after receiving the email notification.

I have only first two restrictions on my BRP.

My suggestion would be to wait for few more days for your BRP card.
