Could someone help answer my question?
I have lived in this country for more than 21 years, most of them as an over stayer.
I had applied for the old 14 year rule, when I was legible. There was a problem with the payment going through. Before I could do anything about it, I became seriously ill and nearly died. It turned out that I had a broken back as a result my illness.
By the time I recovered from the illness (fully fit), the 14 year rule was no longer available. I had to apply on right to family life. At the time I applied, I had been living with my partner (British born and bred) for seven years and we already had three children (British born). I was the only bread winner, even though I legally had no right to work.
I was given a BRP for two and half years. The BRP allowed me to legally work and live in the country. I am working and am the only bread winner for the family.
The BRP will expire in six months' time. What am I entitled to apply for - is it for extension of BRP for another two and half years or can I apply for ILR?
I have been married to my then partner for more than a year now. Our eldest child is eight years old and the youngest is four.
