Application for BRP extension or ILR

Post by mulozi » Sat Jun 27, 2015 11:18 pm

Hi Everyone,

Could someone help answer my question?

I have lived in this country for more than 21 years, most of them as an over stayer.

I had applied for the old 14 year rule, when I was legible. There was a problem with the payment going through. Before I could do anything about it, I became seriously ill and nearly died. It turned out that I had a broken back as a result my illness.

By the time I recovered from the illness (fully fit), the 14 year rule was no longer available. I had to apply on right to family life. At the time I applied, I had been living with my partner (British born and bred) for seven years and we already had three children (British born). I was the only bread winner, even though I legally had no right to work.

I was given a BRP for two and half years. The BRP allowed me to legally work and live in the country. I am working and am the only bread winner for the family.

The BRP will expire in six months' time. What am I entitled to apply for - is it for extension of BRP for another two and half years or can I apply for ILR?

I have been married to my then partner for more than a year now. Our eldest child is eight years old and the youngest is four.

What exactly does your BRP card say?

It is likely that you will need to extend the visa for a further 2.5 years.

Hello CR001,

Thank you for responding. The card says . . .

LEAVE TO REMAIN. WORK PERMITTED.

Would it be advisable for me to apply through a lawyer or apply directly?
