Tier 2 Visa still Valid???

Post by plazog » Sat Feb 26, 2022 7:22 pm

I had Tier 2 work visa issued in 2019 (expiry may 2023).
After I received it, the employer couldn't take me due to its internal problem and I didn't travel.
However I haven't received any information from UKVI that it is cancelled or curtailed or what so ever. Shouldn't the company inform UKVI that I haven't started/joined?
Is it possible to say that it is still valid....which may be transferred to other employer?

If you haven't travelled then it would have been cancelled.

You cannot transfer your existing visa to another employer. You have to apply for a new skilled worker visa with the new employer sponsoring you and issuing a new CoS.

Thank you CR001.

Is there any reason why the visa is not transferrable to other employer? (Unless it is cancelled)
What is the proof of cancellation for the visa if I have not received anything from UKVI?
When they curtail it, I heard they give 60 days for either transferring to another employer or leave UK.

You only get a 60 days curtailment if you had been in the UK. You don't get this if you are abroad, the visa is simply cancelled and often you won't be informed. You do not need proof of cancellation to apply for another visa either.

These visas are not transferable between employers. Each visa is specific to the sponsoring employer.

If you get another employer, you have to apply and pay for a visa again.

Transferring to another employer involves a new visa application sponsored by the new employer with a new CoS. It is not simply transferring an existing visa to a new employer. That is not how the skilled worker visas work.

Thank you for the explanation which cleared all my doubts.

Unfortunately my job role is not in the current shortage occupation list. (aviation engineer)
So impossible to begin a new application. Thanks for your help.

Cheers!

It does not have to be in the shortage occupation list to get a visa. You just need to find a company willing to give you sponsorship.

Is that possible? The purpose of the shortage occupation list is confusing. Nowadays vacancies ask "the right to live and work in UK". That is okay to give priority for citizens and residents, but if employers don't get enough people, how can they do it while the job is not in that list?

Thanks a lot for the good information.

One purpose of the shortage occupation list is to make it easier for a licensed sponsor to employ a migrant worker with a qualification included in the list. But it does not mean that the job must be there for a non-UK worker to find a job in their field.

The "right to work in the UK" statement in the adverts can be confusing. In theory, every worker holding a valid Skilled Worker/Tier-2 has the right to work in the UK. However, some posts include that statement in a way to say that they will not consider applications from migrant candidates or requiring sponsorship (or a CoS).
