28 days rule Tier 2 to ILR application

Hi Gurus
I am in UK since Sept 2010 with Tier 4 visa to start with, then PSW switched to Tier 2.
My first Tier 2 General biometric card shows date of 6th June 2013, so 28 days before my 5 years would be 10th May 2018, can I book appointment for 10th May itself ? Was trying to book for 11th May but appointments not available for 11th, so just checking if I will be fine with appointment on 10th May ? Please advise

Hi

To answer 6.1 When did you (the main applicant) first enter the UK? This refers to the date you entered the UK at the beginning of the period of stay on which this application is based.

As I was in UK already with Tier 4 and Tier 1 PSW visa while switching to Tier 2 General, what entry date shall I put in this please? The one I actually first entered in UK as student or the date I was granted Tier 2 as my this application is based on Tier 2 route? I am bit hesitant in mentioning Tier 2 date as I was already in UK and question is clearly when I first entered in UK.

NARIC Certification

Hi Gurus

My wife applied for NARIC comparability and English Language assessment for her Master's degree from India. Got this message from NARIC

"Your Statement of Comparability application is now in progress.
For English proficiency level, NARIC can confirm that your degree may be equivalent to CEFR level B1 and higher but at this moment of time NARIC can only certify for CEFR Level B1 only, for any level higher it may need further investigation which will involve local team and could take 3 to 4 months time. Please confirm if CEFR level B1 English proficiecy is sufficient for this order?"

Reading through ILR guidance and Set O form I understand that Level B1 is sufficient, so this certification of Level B1 from NARIC would do the needful for my wife's dependent ILR application but could anyone confirm if I am correct in my understanding?

Yes B1 is all your wife needs so this would work.

Proof of Cohabitation- Dependent Tier 2 G to ILR

Hi Experts

Please advise if I need to include proof of cohabitation for my wife as dependent Tier 2 General to ILR application? My passport shows her name as wife and her passport also got my name as husband.

Do I need any other document?

And if so, how many documents and does it need to be all 5 years or just last 2 years (post Tier 2 extension would be enough) as I think I submitted some documents while applying Tier 2 extension, so UKVI must be having that information already.

"If you have a spouse or civil partner listed in section 2 of this application form who is applying
at the same time as you, please provide documentary evidence of cohabitation since you
were last granted leave (up to a maximum of two years). Evidence provided should cover the
whole period and be in the form of official letters or documents, addressed to yourself and
your spouse."

Yes you need to provide proof of cohabitation for 2 years - letters should be addressed to you/your spouse or both, spaced evenly, 10 documents should be fine.

The name proves that she is your wife but what they are looking for is that you have been living together for the last 2 years. Letters such as GP, Council Tax, Utility, Phone Bills, Bank Statements etc should work.

6.13 & 6.14 Dependent's absence from UK

Hi Experts

I am bit stuck on Page 23 of Set(O) form 6.13 and 6.14. My question:

Do I need to fill in my dependent (spouse) absence from UK in the table provided in the form for last 5 years her travel to India and some holidays to Europe since she is on Tie 2 dependent visa?

Yes, that is what confusing me. This states only from 11th Jan 2018, but then how will caseworker will establish that my wife was in UK all the time and never was away for more than 180 days in any 12 months period?

You are overthinking. The 180 days absence limit DOES NOT apply to PBS Dependants whose visa were issued BEFORE 11th January 2018!

Promotion

Hi Gurus

I had promotion in September with 10% salary increase from 1st October 2017. Same job role but with added responsibilities of a Lead. Would this need HR to notify HO by SMS ? Though I got a new offer letter in September for that. Just to let you know my salary was already at ILR qualification mark before this promotion and salary increase.

PS: Eligible to apply for ILR in May 2018.

Hi Guru

Many Thanks for all the support in my ILR application. Today I got my ILR approved successfully.

Now please be kind enough to guide me through my UK born daughter's citizenship/passport application. Where can I apply and how much is the fees?
