Spouse Visa Queries - Applying in India

Post by tripas33 » Sat Sep 12, 2015 5:23 pm

Dear All,

My wife in India has to apply for UK visa in couple of weeks from now. We are not sure which category to choose for online application. She has to apply for a dependent visa from India.
I am on ILR visa in UK for last one year. Earlier I was on Tier-1 General visa.
Can you kindly guide on which visa category should she select , would it be Tier-1 ( General) dependant category under work visa or Wife category under settlement ?

Thanks,
Tripas

Spouse Visa Queries - Applying in India

Post by tripas33 » Sat Sep 12, 2015 5:26 pm

Dear Friends,

I am really stuck with my application for my wife in India. We got married more than a month ago and I am preparing documentation to apply for her visa. I am on Permanent visa in UK , earlier I was on Tier -1 (G) visa.
I am stuck with the proof of accommodation for her visa application.
I don't want to rent a place and pay deposit/rent and agent fees before her visa is approved. As a matter of fact the application guide for VAF4A also advices don't make any payments for accomodation until the Visa is approved. But still the application has section for accomodation details and has requested supporting documents for the same. I am presently sharing accomodation with the family and plan to move to independent house after my wife's visa is approved.
For wife's visa application , one of my friend in UK who owns a detached bungalow has agreed to sign a tenancy agreement between me and him renting is 1 double bedroom in his 2 bed room bungalow. I am thinking to submit this tenancy agreement with the application to show proof of accomodation. Do you think this will 100% work and will not be an issue for rejection ?

I am not able to understand whether the accomodation proof is mandatory or not as the guide book wordings say , you may wish to submit the document and also say that do not make any payments till the visa is granted. Below is the text from the guide ...

Accommodation details

You may wish to submit any of the following documents to provide us with evidence of your accommodation. We advise that you do not make any payments for accommodation, travel and so on until you have received your visa.

Details of the accommodation that you and your sponsor intend to live in and permission for you to stay there along with evidence of any other occupants
This could include:
 Land Registry documents
 mortgage statements
 rent book or tenancy agreement
 council tax statements
 property inspection report
 utilities bills
 accommodation details with a supporting letter from the occupant/ landlord confirming that you are able to stay there

PLEASE HELP !!

You can submit a tenancy agreement as you have described. The list HO states is NOT mandatory but you do have to provide proof of your accommodation and the agreement plus a letter from your landlord as a start would be good.

Does she also need to give Life in UK test for the visa ?
No, it is only required when applying for ILR. She needs English A1 test for spouse visa, from the approved list of providers.

Do you know how much I will have to pay towards IHS for Spouse settlement visa ?
For applications from outside the UK, it is £600 for the first entry clearance visa, payable before you apply.

Can you further help..

She has a Degree taught in English listed on PBS calculator on UKBA site hence no need of A1 test ?
Should the photo copies of my passport and UK visa with my wife's application be notarized or normal copies would do ?
Is it mandatory to submit wedding invitation cards with the application form (as they all have been used and were in local language ) ?

Thanks Again.

Should be fine. I am not sure if she will need a NARIC assessment.

Should the photo copies of my passport and UK visa with my wife's application be notarized or normal copies would do ?
Photocopies should be fine, notarise bio page of passport and BRP or all of the copies if you want to be on the safe side.

Is it mandatory to submit wedding invitation cards with the application form (as they all have been used and were in local language ) ?
No, I don't think so, as you are already married, you need marriage certificate.

Hello Friends,

Regarding my employment with regards to sponsoring my wife is as below...

I was a contractor earlier ,contracting through my limited company but now from September month I have a permanent job. With my wife's application I am submitting my last 6 months payslips as I was director of my limited company and was drawing salary from the company account and dividends. I am submitting dividends vouchers also and letter with from my accountant.
I am also submitting the employment letter from my current employer for my permanent job.
Do you think its fine in terms of financial requirement for my wife's settlement visa ?

Thxs
