Married before Divorce in Uk granted

Hi all, I ask this case In other site but em not very convinced, hope anyone here done our case and can help me what the best to do, me and my British husband married in Philippines in Civil why he's divorced on proceeding, our marriage was last March 2017 and divorced decree granted January 2018 , we are applying on June for spouse visa, it is a cause of refusal? Anyone done similar this case? Please help.

Yes it will be a problem as your spouse was not free to marry at the time.

For a visa, UKVI will see that your date of marriage is before the divorce decree absolute, which has to be submitted with your visa application to prove you were both free to marry and not married to someone else.

As CR001 has advised, your marriage won't be recognised as legal and a Spouse visa application will fail.

You could however, consider applying for a fiance visa to marry in the UK within 6 months and then switch to a FLR(M) Spouse visa.

Hello , and how they will consider the Visa for Fiancee is ok coz we already married in My country. We can't get any CENOMar that we are single Coz our marriage was registered already, I have read here this site that same as my case and they granted a visa

Your issue may require you to have written permission from first wife to state she agreed to second marriage. Are you able to get such statement?

This would be irrelevant for the purpose of a spouse visa to the UK where polygamy is not recognised. The OPs spouse needed to be free to marry at the point they got married.
