Advice needed

Post by Williamuk5714 » Wed Mar 18, 2020 12:49 pm

Im a British Citizen and my wife and her child both have dual nationality passports ( Turkish and Swedish) We got married in 2010 in the UK

They have been in the UK for over 10 years and my wife has been working in a care home for the last eight years paying UK tax and National insurance.

Naturally I want them to stay in the UK but we are very concerned as to where we stand now as far as their rights to stay in the UK.

Advice would be greatly appreciated.

William.

Hello

There is nothing to be concerned about. They are EU. They can just go for the EU Settlement Scheme and it's sorted. It takes 15 minutes max to do.

She entered the UK in 2009 on a EU Swedish passport. Since then her Swedish passport has ran out and she is unable to renew it due to unforeseen circumstances ( outstanding issues with her ex husband)

We are both very worried about how she can now stay in the UK and we both dont know the best Avenue to go down so she can stay. Its a very worrying and stressful time for us both so if anyone has some advice it would ease our fears.

Advice would be greatly appreciated.

Assuming that she and the child are now Swedish citizens in their own right, can you elaborate on why they need any evidence from the ex-husband? Surely she should be able to apply to the Swedish authorities with proof of her citizenship. (I'm assuming that she has a Swedish National ID card).

Help and advice needed

Post by Williamuk5714 » Wed Mar 25, 2020 5:38 pm

My Wife and I were married in the UK in 2010.

She has lived in the UK for over 10 years and has been working 8 years and paying UK tax and N.I

She entered in 2009 on a Swedish EU passport , She also has a Turkish passport. Unfortunately the Swedish passport expired in 2015 and she is unable to renew it due unforeseen circumstances. ( Complicated situation with her Ex husband)

Whats the best options for her to apply to stay in the UK?

Any help would be really appreciated in this stressful situation.

Many thanks.

A legitimately acquired passport is easily renewable without the assistance of any family member.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

So why would that prevent her from renewing a passport that is genuine?

Is she still married to the other person?

Have you spoken to the embassy??

We are scared because she just left Sweden and he still had access rights and that may affect her being able to renew her passport

So effectively parental abduction on her part if the child's father had access rights or joint custody.

It is useful if you state all the facts when asking for advice.

It appears based on your most recent post, that no one has spoken to the Swedish embassy to find out and you are merely scared and don't want to try apply for a renewal.

Does she have a Swedish id card?

There is no miracle here. She needs to contact Swedish authorities in London and start the process to renew her documents.

As long as the doc is legit, she should be able to renew it.
