ILR for my PBS dependent wife . .

ILR for my PBS dependent wife . .

Dear Members

I was just looking at Vinny's post about changes in immigration rule for PBS dependents who were granted entry before 9 July 2012.

My wife came to the UK on the 1st of Dec 2011 on a Tier 1 (G) visa and we extended my Tier 1(G) visa along with my wife's as a dependent back in July 2012 which is valid up until July 2015. However, in January 2014 I was granted ILR based on Long Residency and then applied to change my wife's visa category to FLR(M) in Feb'14. Decision on her FLR(M) is still pending and we haven't received her biometric letter yet.

I am now concerned for the new immigration rules. Would my wife still be eligible to apply for ILR immediately once her FLR(M) is approved or she would have to wait for 5 years? This would devastating for us.

Please help me with this. Regards

She should be under the old rules as she has already made her application.

Thanks for your quick reply Vinny.

If she falls under old rules (given we have posted her application on the 17th of Feb'14), would this mean that as soon as we have her FLR(M) approved we can immediately apply for ILR under SET(M)?

Please clarify .. these immigrations rules are restricting our lives .. and after all these years I regret my decision of migrating :(

Your response with clarification would be highly appreciated.

This post is similar to my situation. I was also tier 1 general and received 10 years ILR on February 2014. I am thinking to post flr(M) my wife application this week.

Hoping I should be fine ,submitting application before 6th April 2014 by post.

Hey esmsi. . . Good luck with your wife's FLR(M) application. I'm still waiting for my wife's biometric letter. I called UKVI on Friday as it has been more than a month since we posted her application . . it appears that they have her application on their system and didn't even bother to issue a biometric letter yet. I was advised to wait for another month for biometric . . . let's see how it goes!!
