ILR settlement as a dependent

Post by roopranga » Sun Mar 23, 2014 10:54 am

Hi,
I have been living in UK since June 2007 as a dependent of my wife. At first she was student so I had student dependent status. Later on she switched to PSW and eventually got her ILR (10 yrs) in May 2013. Last time I renewed my visa was two years before when my wife had PSW. My visa will expire in May 2014. I have had my Life in UK test done but not taken English language test. I am very confused in following issues:-

1. Can I apply for ILR settlement directly as it has been 7 years that we married and living together in UK?
2. Do I need to take English Proficiency Test as well?

Could some help me please.

When your wife applied for ILR on 10 years long residence, you should have applied for FLR(M).

You are right but its too late already. Do I still need to fill up the FLR(m) form for extension & take English test?

You need to apply for FLR(M) before April 6 otherwise you'll be under the new rules! A1 English required.

I am still confused as Section 8 (English Language Requirement) in FLR(m) has clearly mentioned-

'From 29 Nov 2010, a person who applies to enter.....'

I applied as a dependent in 2007. It is just that I am renewing every year or twice since then.

Doesn't this mean that people who already applied and living as a spouse before 29 Nov 2010 will not be included in this?

FLR(M) requires A1 English, points on PBS calculator should suffice.

I have now concluded that its not possible to meet deadline of 6 April as minimum time for English test is 7 days for the certificate. I have to apply after 6 april. Is new rule going to be harsh?

Hi esmsi, thats a brilliant idea. Can I mention about submitting the certificate later in the section 8 of the FLR (m) form?
