Spouse Visa Enquiry

Hello All,

I have got a question : I have a friend (non-EU) who is married to his English wife. They were living together in UK but not married , I don't remember very well but might have been in year 2013 when they moved together . Anyway, the police returned him back to his country as he was illegal and his wife came to his country and they got married, when he first applied for marriage visa , home office refused but his wife took the case to the court and after 1 year and 2 or 3 months (as he stayed in his country) he was granted spouse visa. He got his visa in January 2014 for 2 years and 3 months. Now , please can you tell me (someone that knows the rules) when his visa expires after 2 yrs and 3 months does he have to re-apply for Indefinite leave? if yes , when does he have to apply for British passport? If not , does he have to apply again for another 2 years and a half visa and then after apply for Indefinite leave?

I have heard that rules for marriage visas have changed and have heard that you have to apply for a visa every 2 years and half , four times ...which is 10 years in total and after 10 years you get indefinite leave and after you can apply for passport

Please could someone clarify this to me

As you've been advised, he will have to apply for a further 2.5 year extension and meet the financial requirement at this stage and also at the end of the 5 year probationary period when he can apply for Indefinate Leave to Remain (ILR). Assuming he is still married to his British wife when he receives ILR he can apply for British Citizenship.

Thank you very much for taking your time to answer my inquiry , ok I thought that he needed 10 years to apply for indefinite leave
I have heard from some people saying this , anyway from what u saying , after 5 years of staying he can apply for ILR.
