British Passport or Visa

Dear All,

Me and wife will get the British passport soon as we have naturalised already. Our daughter was born here and she also has naturalised. We all have the citizenship ceremony to attend and then we will apply for the British Passport.

The question here is that we have a son who was born in India and his visa has expired. Can we apply for his British passport while he is in India or do we have to apply for he visa first and then the British passport.

He is 10 years old now. Do we have to provide some documents to show that we are supporting him. We have not seen him for 4 years now as we could not go to India.

Please provide the details for financial and accommodation requirements too.
What shall we do ? Please help

Your son in India cannot apply for a British Passport because he is not British.

You will need to apply for a child settlement visa from India and will be expected to meet a residence period in the UK and gain ILR before being able to apply for citizenship.

The length of residence in the United Kingdom is less important for children under 13. If they are satisfied that their future lies here, and that registration would otherwise be appropriate, they need not normally take into account the length of residence here.

Therefore, based on what you have stated if both parents are British, the child needs to enter the UK with ILE then be registered as British in the UK immediately.
