Hi,

I had come UK 20th Sep 2009.As per the 6th April 2010 rule I am eligible to apply for ILR on completing my five years by 20th Sep 2014.I got married on 8th Dec 2010.Me & my wife have been staying together in UK since from 8th Dec 2010 after marriage till today.
Also my wife had come to UK in 10th March 2010 before our marriage and she has the eligibility to apply for ILR on completing her five years by 10th Mar 2015.

We are working in the same company with our individual Tier2 ICT visa. Now We have baby due on mid of July 2014.
In this situation I have few concerns that how/when can we apply for ILR. Please find my concerns below.

1) Can my wife apply for ILR along with me as I complete my five years in uk earlier than her & We have been staying together in
UK since from 8th Dec 2010 after marriage to till date i.e. more than three years?
2) Can our baby ( due date is on mid of July 2014) be eligible for ILR along with us?

Could you advise/suggest for my above queries ?

1) Your wife is not your PBS Dependent its better you both applied separately on completion of your five years.
2) you don't need to include your child application along with your ILR application in 20 Sep 2014. Once you got ILR your baby will be eligible to apply British Citizenship Certificate.

Thanks for your suggestion. could you please clear few more doubts.

1) My wife will go on maternity leave for 39 weeks (as per UK law) from 1st July 2014 and she will be completing her 5 years
during her leave. Does it have any impact on applying for ILR?
2) She will be getting the reduced payment (say £400 per month )during maternity leave. Will it meet the salary criteria for
applying ILR?
3) Can she visit out of UK ( India) before applying for ILR and if yes then for how many days?

Hi,
My wife had come to UK in 20th March 2010 with Tier2 ICT visa. she has the eligibility to apply for ILR on completing her five years by 20th Mar 2015.But just wanted to know the rule applicable for her ILR apply on the above mentioned condition.
