I'm sure she can find a document list on the website of Belgian Embassy in her home country.

When my civil partner applied at the Embassy of the Netherlands in 2011, we just produced:
-completed application form
-both of our passports
-our civil partnership certificate
-a copy of our flight booking
-passport sized pic (1 I think).

You should check the Embassy website before coming back here to ask detailed questions.

I applied as a British citizen for a visa for my non-EEA civil partner to go to the Netherlands with me under Directive 2004/38/EC. This Directive doesn't require financials. Read the following links to get familiar with the Directive:
eumovement.wordpress.com/directive-200438ec/
http://eur-lex.europa.eu/LexUriServ/Lex ... 123:en:PDF

If you have specific questions please email VFS (the company that deals with Belgian Visas in India directly via email): http://www.vfs-be-in.com/contactus.html.

Don't get confused with the national legislation in the countries where you are living. The above is European Law.

In Beijing, all dealings for the Embassy of the Netherlands are now with VFS (or other visa processing companies). I guess India will be the same.

RE: Your son: tell us more details about his citizenship etc and someone will probably have an answer for you. If he is non-EEA he will also need the visa, the same as your wife. However, the process should be quite straightforward and its free. You will need his birth cert.

When did you become a British citizen? After your child was born?

You might also want to ask some more direct questions on: www.britishexapts.com

My son is Indian national and he was borned when I hold Indian nationality. So he is not a British citizen by descent. Should I go to India for apply visa for my wife and son?

hi
you do not have to pay visa fee , marriage certificate . copy of your passport etc and letter that your spouse is joining you there etc .but you have to check with embassy as they should have a full list like some embassies require translation of documents as well .
always check with relevant embassy as on forum you get the general advice according to laws but thats the embassy who deal ith visa application.
but if there is still any problem you can always ask here
You may have to fight a battle more than once to win it.

Dear all,

I wonder if you can help me with the subtelties of the EU free movement/family reunification directive, as it is applied by Belgium.

I am a UK citizen living in Belgium, recently married to an Indian woman.

My question is: does the EU right to family reunification apply if I married my non-EEA spouse after becoming a Belgian resident? Or would it only apply if she was already my family member before exercising free movement rights?

Let me know if that's not clear!
Thanks in advance!

Paul
