Switching from Tier 2 ICT Longterm to Tier 1

Post by sat_bab » Mon May 12, 2014 10:38 am

Hi All,

Apologies for posting this in general section as i am not sure if my query relates to "Tier 1 general" or "Tier 1 employer sponsered".

I am currently in UK (since October 2010) on TIER 2 ICT Long term leave to remain visa. This visa is initially processed by the MNC IT company for which i work, in October 2010 and then got extended twice. Currently it is extended till April 2015. I would like to switch to Tier 1 visa and work for the company/job i can get here on my own.

Please can you guide me if my current visa is eligible for me to apply for a tier 1 visa? Also, in that case will it be Tier 1 general or Tier 1 employer sponsored visa that i should pursuit? FYI, I have one dependent. Sorry if i am asking a very obvious question. I am bit confused as the UK BA rules kept changing in the recent times

Do you mean Tier 2 (general or employer sponsored). Tier 1 route is closed for new applications unless you meet the following criteria
2. Eligibility

You must have permission to stay (‘leave to remain’) in the following immigration categories to apply to extend your stay in the UK under Tier 1 (General):

Tier 1 (General)
Highly Skilled Migrant Programme (HSMP)
writer, composer or artist
self-employed lawyer
https://www.gov.uk/tier-1-general/eligibility
Char (CR001 not Casa)
In life you cannot press the Backspace button!!
Please DO NOT send me a PM for immigration advice. I reserve the right to ignore the PM and not respond.
