Family Visitor Visa got rejected! Plz Help!!

Post by desilemons » Fri Jun 06, 2014 2:38 pm

Dear all,

My sister-in-law (SIL) applied for a family visitors visa in India along with her mother, my mother-in-law (MIL). My MIL got the visa but SIL got hers rejected.

We showed that my MIL is sponsoring and supporting my SIL. And I was providing the boarding and lodging support whilst here. So we attached MIL's bank statement, property and other residential IDs. SIL attached a copy of those and some of her residential IDs. And I provided my usual supporting letter, pay slips and utility bills.

The consular mentioned in the refusal letter:
"In reaching this decision, I took into account the fact that you stated that you are being supported by your Mother, however, I must assess your own individual/personal circumstances for the purpose of determining whether or not you qualify for a UK Visa. You have not proven that you have any strong social and economic ties to India which would be construed as a reason for you to leave the UK as the end of your visit. You are neither studying nor in employment. As as result, I cannot ascertain that your circumstances, as evident, would constitute a strong incentive for you to return to India. I am not satisfied that you are genuinely seeking leave as a visitor for the period stated or that you intend to leave the UK at the end of your visit (Para 41(i) & (ii) of HC as amended)."

Now the thing is, my SIL never applied individually and it was always the intention that my MIL was sponsoring her visa application. My SIL has just finished her studies and now about to join a job. She has the joining letter. This is the reason we did not mention her as studying or in employment. She does have some balance in her bank account, which we could have shown. All we wanted was that they both can come and go back together which would be a real help for my MIL.

Now the questions are:
1) Why my SIL's application was considered separately?
2) Why did they not consider my MIL as her sponsor?
1) Where did we go wrong?
2) What can we do now as we are planning to apply again?
3) And what documents we can attach this time?
4) Would it be worth to attach that offer letter and NOC from that employer?

Any suggestions will be really helpful.

Regards.

Why my SIL's application was considered separately?
Because she is not a dependent (under 18) on your MIL. If she is over 18, she has to meet all the requirements herself. You should have submitted the offer letter.

Thanks CR001.

Do you think we have a good chance of getting the visa if we re-apply with that offer letter, NOC from the employer, and couple of financial documents, along with supporting and sponsoring documents from my MIL or even BIL please?

Its better not to talk about that offer letter but instead state that she is actively seeking job which she will not start anyway until her return to avoid break in new job i.e. joining and going uk.

but do attach some sort of prove of her ties and confirmation that she will return and if you do want to attach an offer letter then state something along the lines that she did have offer letter and expected joining date but you did not attach before as you thought case does not depend on it

make sure you have provided enough financial proof for her and reason to show that she will return and letter from your MIL that she will sponsor and bear all expenses if your MIL's banks statement is being used

Thanks Ali.

Can you or anybody else suggest what other documents we can attach to prove the ties with India please?
