My residency permit died on November 2014 so can 'I apply for the indefinite stay from now or should I wait until November.

My husband is EU I'm In UK since October 2009 and since didn't left England anywhere ,I had my residency in November 2009 and no it expired on November 2014.I want to apply for indefinite live ,wandering if I can apply for it before November this is my question

you can apply before if you already have 5 years residence in uk .
