Dependant visa category for spouse

Post by kartikmail » Sun Sep 07, 2014 1:19 pm

Hi,
Both my wife and I are on Tier 2(ICT) visa.
My Tier 2 visa is due for extension in January 2015. Since I would be eligible to apply for ILR in Feb 2015, my Tier 2 visa would get extended only for 1-2 months.
Since my wife's Tier 2 visa expires in March 2015 & I intend to switch her to dependant visa,

1) Which visa category would be applicable for her after I get my ILR ?
2) What would be the process of application for the same?
3) What would be the duration of the dependant visa?

Kindly guide.

Best Regards,
Kartik

Well if your qualifying period for ILR in Feb 2015, you are entitled to apply 28 days before your qualifying period, unless of course Feb2015 is 28 days before your qualifying period.

The other thing you can do , to save yourself money, is to make a postal application, and vary your extension application to ILR under the PBS, paying the difference in fees and using SET(O), subject to you passing the LIUK test and English Language B1

If your wife came in before 9th July 2012, and has been living with you since, she may be able to qualify with you, other wise she can stay on Dependent Visa and qualify after 5 years of continuous residence with you.

She is not require to switch to another type of visa, she can simply carry on with the dependent visa, until her 5 years qualifying period.

@Obie, not sure if I am reading the OPs post correctly, but I understand it as they are each on their own Tier 2 ICT visas.

Why would a dependents leave expire after the main pbs spouse?
