What do you mean: "few weeks ago we applied for a family visa to revisit"? Do you mean an EEA family permit? Or do you mean that you applied for another type of family visit visa (not an EEA family permit) and have received that already?ben72 wrote:Dear all,
May I seek some advice, I am a british citizen living in Spain, I have moved here to be with my partner (Non European national) 3 years ago we have a beautiful daughter now, I have worked for a year and a halfhalf I had to look after my daughter as my wife to be was earning much more than I was. Previously we applied for a visiting visa to visit the UK, few weeks ago we applied for a family visa to revisit, however, we have decided to go back to live in the UK now. My questions are:
1) can we still apply through the SS route having been granted the visiting visa?
2) as she's entitled to her tax contribution when she leaves the country with a condition to give back her residency card in Morocco (country of origin) to receive the remaining 60% can we travel to the UK from Morocco having applied from Spain? And with the EEA family permit can she travel freely from the UK to Morocco on that 6 month period?
Your advice and guidance is very much appreciated.
SHE CAN TRAVEL TO THE UK AS LONG AS THE VISA IS IN DATE.ben72 wrote:Many thanks Clive, I really appreciate your help and advice.
I guess the only thing that I need to find out is if we are granted this visa tomorrow can we travel from Morocco instead of travelling from Spain if that would be possible it would help a lot. YES, OF COURSE YOU CAN BOTH ENTER THE UK DIRECTLY IF YOU HAVE A VISA WHICH ALLOWS HER TO GO WITH YOU.
One last question please; once we are granted the visiting family visa do we have to go to the UK immediately and apply or can we travel later as long as the visa is still valid? Since the application take some time.
My partner entered the UK from China on visitor visas 3 times. No issue.ben72 wrote:Thanks Obie,
My only concern can we enter from an non European country with a visa? Regardless which type of visa we are applying from Spain but will be travelling to the UK from Morocco.
Can anyone please advice on the above!!!ben72 wrote:The family visiting visa has arrived this morning! The next thing is preparing all the documents! One question:
Can we show the documents to immigration at the airport to explain our intention since our circumstances have changed? or not necessarily and just apply for the EEA family permit EEA2 once we get in?
Many thanks
I'm not sure that anyone will be able to advise you on that here. I haven't noticed this kind of situation being mentioned here. I'd advise you to contact the 2 email addresses I pasted above.ben72 wrote:Can anyone please advice on the above!!!ben72 wrote:The family visiting visa has arrived this morning! Are you in a rush to enter the UK? Don't forget to make copies of any of the documents that you get there!ben72 wrote:Hi Chaoclive,
Thanks for your reply, I have emailed them and yet to receive an answer, hence I'm panickingsince my wife will be handling back her Spanish residency card Im scared that might disqualify her for the SS route.
