Chances of success?

Post by Iwanttostay » Thu Dec 11, 2014 12:07 pm

Hi - I applied for my ILR on Dec 2nd, with the approach that it was merely a formality as I had dotted all the i's and crossed all the t's... however, I wasn't aware that the salary minimum had gone up (effectively £10k in my SOC code)... I was advised my case worker, and his senior case worker that all I needed was to speak to my employer, get a raise and reapply... I just needed one payslip reflecting this new salary.

I have done this - however, my net payout will be roughly the same as my previous month salary due to a couple days of unpaid leave in December... will this be a problem or am I now being paranoid?

I have no idea how the case worker's work - i.e, I just thought they checked all the docs and made calls when/where necessary - so, would I be correct in understanding that I can submit all my docs on Dec 19th (my next appt - I really want this done before I leave on holiday!) and this should all go smoothly - with a possible call to my contact on my letter of employment to confirm all this?

Or should I be submitting more info?

I would SO appreciate any advice on this... I called one of those 'free immigration lawyers' for help, but he kept trying to insist that I bring in my paperwork for them to look at... I don't have any 'paperwork' other than the docs required for submission...

Thanks,
Jan

If your pay goes up 10k as you say that is 200 per week. So is a very noticeable pay increase. Having a couple of unpaid days does not knock out 800 of pay. So I would be worried as that your are saying does not make sence. You are going to have to show two things a payslip that has a goss of at keast one twelfth of the required SOC salary and a letter of confermation of the salary inrease.

+1

Does seem very suspicious, hands up those who've ever walked into the boss's office, said 'Can I have a £10k pay rise?' and the boss says 'Yes!!'

If he did you should have gone for £20k....

It doesn't surprise me. I guess OP has a hard to find skillset :)

@OP if the last payslip shows a gross salary that now meets the minimum SOC, you don't need to worry about the net pay.

Thanks for the replies! (especially @kevb2014)

I guess I'll just have to go along and see... the increase really equates to roughly £3 an hour, which, to be honest, isn't that much... my boyfriend has just received a £50 a day increase, so I'm not sure why this is so surprising? (Added to which, if this is the minimum salary required... then not too sure how it could be so shocking?)

Also, 3 days of unpaid leave equates to roughly £480... so, it did knock a whack off!

Thanks again - am hoping that my payslip, letter from my employer and calls to them if need be suffice... any other advice on what to submit would be awesome, but to be honest the sarcasm isn't helpful!
