Tier2 Birth Registration of New Born in 1 week

Hello,

I am on Tier2 visa and which will expire at a time when I am expecting a new born in family. Baby's due date is 20th Feb'15 and Visa will expire on 10th Mar'15. So, in nut-shell I will have hardly 2 weeks to get both Birth Registration and Passport done.

Please advise on the following:
1. Can Birth Registration be done on Tatkal/Fast Track basis like Passport Service? If yes, please guide on the process.
2. What is the average processing time for Birth Registration? HCI website says 7-8 working days for Birth Registration, however, I read they can take 4+ weeks or more at times.

Thanks Vinny. I have visited this page before posting on this site.

My question is regarding emergency cases where parents' visa is expiring with in weeks of baby' delivery.
Do HCI consider emergency cases and speed up Birth registration process? Normal processing is 7-8 days, however, can it be expedited stating valid reasons?

Please advise.

Sunil,

I think you are trying to mix two things here. Your visa expiring is no where related to your baby's birth certificate. As Vinny mentioned, your baby does not need a visa to remain in UK so its irrelevant whether ur visa is expired. I'm assuming you will apply for the visa extension on time. If you do not intend to renew your visa and plan to go back to your home country, even in that case, the baby does not need a visa. Dont see any reason why HCI should expedite the birth certificate for this specific reason. Are we missing something?

My question here, in case our visa expires and baby's birth certificate is not done by HCI, then what will happen?

What will happen to whom?

From the two given links above, nothing will happen to the baby. Baby does not have to apply for leave to remain and baby does not have to register at the Indian High commission for at least one year; after a year, applications will be forwarded to Ministry of Home Affairs for their approval.

However, if you let you leave expire without applying for further or indefinite leave in-time for you and your partner, then you and your partner will become overstayers. There may be significant detrimental impact to you and your partner.

Thanks Vinny. Sorry if I have upset you :). I am relatively new in this.

Aw rightly pointed out by you, I was asking about impact on us. I know baby is not impacted in this process. I was worried about us. We will be overstaying if HCI exceeds time frame for birth registration beyond our visa limit.

I will rephrase my questions here:
1. Do HCI consider for TATKAL service to cut-short their standard processing time of 7-8 days?
I am considering a case where my visa duration is not sufficient to cover birth registration and passport processing time. HCI website states birth reg doc is required for passport application.
2. In case, our visa expires before documentation is complete, is it possible to legalize overstay by any means? Extension of stay for 2-3 weeeks,

Isn't it more logical/simpler to apply for parents' leave to remain first, before applying for anything for the baby?

If you have no plans extend your visa,then you need to apply for birth certificate. aftr which you need to apply for passport so that you can go bac to your country. both the process take only 7 days for each.

if you plan to extend your visa, you can apply for her birth certificate once u get ur extension.
