Renewal of Stamp4 EUFAm after 5 years.

Hi,

My stamp4eufam, expired last October.

Before then I had applied for a permanent residence but that failed and so I applied for a review.

I have a 6 month temporary stamp4eufam.

What is the procedure to renew my Stamp4 Eufam? Where do I apply for this? What documents do I need? etc...

You might want to email INIS to double-check, but I think basically a renewal is the same as a new application: EU1 form, proof of relationship with EU citizen, proof of residence, proof of employment of EU citizen, etc.

Yes, as long as at the time of your application you still have an EU citizen family member who is exercising EU treaty rights, they will give you another 5 years Stamp 4 EUFam.

The permanent residence applications is something they are more cautious with, as once granted your rights are not dependent on the UE citizen anymore and they can not easily take it away from you. This is why they will take any option they have to decline it, for exemple if there is the slightest gap of employment/residence of the EU citizen in the past 5 years they will say you were not exercising treaty rights for the full duration (maybe this is what happened in your case?).

So, it is a fresh application as opposed to a renewal.
When I first applied I had to submit a form with supporting documents and so on and the whole procedure took 6 months.

Someone told me that after 5 year eu4fam residence has passed, you can renew the certificate card over the counter?

I think that they were mistaken.

I also think the person who told you that made a mistake. If you want to double-check directly with the EU Treaty Right section at INIS (the people are are processing these applications), you can email them at eutreatyrights@justice.ie. Usually they reply within a few days.

Hi there,

After my 5 year Stamp4 Eufam expired, I submitted and new EU1 application
This has been refused.
All documents were in order.
Proof of address, marriage certificate and 2 payslips were submitted.


INIS called a few days before the decision and was told by the employer that the EU citizen left after 4 months.
EU citizen is still unemployed.

Is the INIS decision correct?
I want to submit a review.
Are there any grounds?

You should not renew EU 1 you should have applied for EU 3.

Was your spouse working for continuous 5 years in Ireland.

I think you should seek review or apply for citizenship .

Actually I did apply for the EU3 and that was refused as spouse did not work for the full period. Also the review of the EU3 failed too and then I applied for renewal of EU1 as this was the only choice left.
I cannot apply citizenship as you need to have more than 6 months left on your residency...

I can only apply for review of EU1 now.

My spouse still not working but studying only part time.

If her situation change after a few months while they are still busy with review can I make new submission?

Also, will they give me a temporary residence permit for 6 months?

Are you working? Or do you have suffiennt resource or medical insurance?
