Switching to Tier 2 General from Tier4 dependant

Hi Gurus,
i am currently working as Bureau Analyst with a company that has sponsorship license and i have been with them for about 3months . am due to apply to switch in the next 3 months as i am currently on tier 4 dependant but i dont know if they will need to do resident labour market test. i am yet to discuss with them about sponsoring me.

my salary at the moment only meet the £20500 mark

Gurus pls kindly provide your views,

or any other possible options.

am new to this forum, so if i have not followed any procedure correctly i tender apologizes

An RLMT is needed.

The job must be at least NQF 6 and meet the minimum salary requirements for the SoC or £20,500, whichever is HIGHER. So if the SoC for your job is £25,000, your current salary would need to be increased (if you pass the RLMT).

Can I ask, if I have studied master and then moved to psw and now a tier 4 dependant, does this have any effect.
Some one was also telling me that since I am already with the employer for this long , they will not have to do RLMT.

That 'someone' is incorrect. It is only your CURRENT visa status of Tier 4 (not dependent)/ PSW that would exempt you. In addition, you will need an RCoS although you can apply in the UK.

Restricted Certificate of Sponsorship. These are issued on one day every month and must be applied for separately from any annual allocation of unrestricted certificates of sponsorship.

Hi guru,
i have just been searching and found the below from Tier_25_Sponsor_Guidance_11-14.pdf
what do you think.I will be 6 months by the time i will applying to switch from tier 4 dependant

Exemptions from the resident labout market test

28.4 This section sets out where you do not have to conduct a resident labour market test
before you can assign a CoS under Tier 2 (General).

Continuing to work in the same occupation

28.5 If the migrant is already working for you and they need to extend their leave to
continue working for you in the same occupation, you do not need to conduct a resident
labour market test.

Hi All,
Can I please ask for response on my issue,
I applied for further leave to remain on the basis of my family : my wife was studying and she was the main applicant and I her dependant and we have a child about 1 and half year old born in uk we have been here since 2010 via student visa and PSW. the university refuse to extend her visa in May 2015 when her visa was expiring while her course was due to conclude on 15 June 2015. she has approved extenuating circumstance that lead to her visa expiring before the dissertation submission date 15 June 2015. my wife is currently pregnant and all these were stated on the visa application that was refuse. we made the application before visa expire in May 2015. we have now received a refusal and asking us to appeal from home country. I have applied for Judicial review on the basis of human right and that I should have right to appeal here in UK. My question is can my wife switch to PHD application as she has two offer of phd study due to start in January. the refusal ended our session 3C and no 3D as no appeal right. if we are granted right of appeal here in UK will they grant us our 3c and 3d right back which should allow us to make new tier 4 application.
please I will very much appreciate your advise. my wife is due to have our baby by october
