Renewal of spouse visa - meeting accommodation requirement

Post by matt1020 » Tue Mar 10, 2015 8:36 pm

Hi, I'm new here so apologies if this post is in the wrong section.

I'm a British citizen and my wife's here on a spouse visa which was granted for 33 months. We are nearing the end of this period so we will need to apply for a renewal. I am in full-tine employment (> £20,000) and my wife has a NARIC certificate at B2 so I believe that we will meet all of the requirements except one.

https://www.gov.uk/government/uploads/s ... _11-14.pdf

21 d. The paragraph at the very bottom reads... In addition you must have adequate accomodation for you and your partner and any dependents that live with you. The property must be occupied only by you, your partner and dependents.

The problem is that my wife and I (no children) live at my elderly mother's place because we take care of her. It's a 3-bedroomed semi-detached house so over-crowding isn't an issue but the requirement (above) clearly states that the property must be occupied only by me, my partner and dependents. We don't want to submit the application for renewal of this visa and pay £601 to find that our application has been rejected just because of this, so I would be very grateful to hear from anyone who has been in a similar situation - and how you approached it.

Many thanks in advance,

Matt.

Your accommodation should be fine. Submit title deed/register or tenancy agreement and a letter from your mother stating you live there etc. Make sure you submit enough cohabitation proof for you and your spouse.
