hi new here

My wife and i are under alot of stress as our LTR is expiring
it has dawned on us apon reading the application that we are not allowed ct or cb (public funds)
we have been advised by a visa company to rather apply for FLR(0) as IDLR would be too high risk for us??

we have been here 10 years in total now an can not return home (South Africa) easily as we are very settled.

My wife is of UK ancestry and im a dependent. we have had 2 children here in the uk.

please could you advise best course of action.
any advise would be most helpful.

Have you stopped the cb and ct yet? You will likely have to pay this money all back.

yes i have recently as soon as i realized it

but i need to apply before end of the month and i have not received anything from HMRC about it.
do i still apply and mention this on the application?

It is a difficult one and time is clearly of the essence. I don't know what to advise to do you in this situation. How have you communicated with HMRC? Hopefully in writing.

FLR(O) is not a guarantee either. South Africa would not be considered a 'difficult' country to go back to and your children still appear very young.

Perhaps one of the other more senior mods can offer you advice on what to do.

i phoned them to cancel as i thought this would be faster. Do i need to write to them ?

Don't even know what to say other than requesting the opportunity to return the monies??

Our links to SA are very weak as we have been here 10 years and we would struggle to return

Our links to SA are very weak as we have been here 10 years and we would struggle to return I do understand that, am from SA myself, but it isn't a war torn country or one where you will suffer persecution for example. There is no 'exceptional hardship' in returning. Just preparing your for what could be said. Do you have other family here?

sorry my browser did not refresh properly and i missed your previous reply.

it was only on Saturday so too soon maybe.. but i will write a letter tonight about retuning the money or further action i can take to make things right.

yes we do have other Family here.
Wife's parents are British
and have her sister here.
