inaturalisation of under 18 child of british citizen

Post by Rachit23 » Mon Apr 13, 2015 6:06 pm

Hi, Can anyone suggest!!!! my under 18 kids are with me on dependent visa since two years.
I have been told by one of the solicitor that they can directly apply for naturalisation because I am British citizen.
Please suggest can I apply direct for naturalisation ??

How did they get the 2 years visa?

I am not sure the lawyer is right about that.

They will have a better chance once they are settled, or the other parent on the basis of which they obtained the 2 year definite leave, in accordance with their own leave, is settled.

my kids came with my wife on spouse visa under the new rules of five years. according to their visa they have to apply for extension before they can apply for ILR then naturalisation.
BUT!!! According to one of the solicitor kids under 18 can apply for naturalisation on form MN1, any time.
I am so confused!!! Please advice what should I do? go for five year route for all of them or get kids naturalisation on form MN1 now and only wife visa extension under five year route?

How did you become British (by birth, by descent or naturalised)?

I have made no secret of the fact that i do not agree with the solicitor that they are entitled to be registered.

I will be content to say that they"MAY" be registered, but that incorporates a discretion in section 3(1).

Unless section 3(5) applies, which incorporates a residence requirement, or Section 3(3) (a)(b) and (c) applies, I believe the views of the lawyer may not be consistent with the law.

thanks a lot for your detailed reply. I would say you have very good knowledge and you are using it to help people like me.

I think it's down to discretion under section 3(1), which applies to me.

once again
thank you
