Tier 1 General - ILR 28 days rule

Hi,
Can someone please help me out to decide when to Apply for my ILR.
I am on Tier 1 Greneral visa (2+3 years)
MY visa start date was 01/09/2010
First Arrival in UK was 18/09/2010
got extended after 2 years
MY current visa expires on 31/08/2015
total days out of UK in last 5 years are 99.

Now the confusion is, if I can go for my ILR before 28 days of my visa start date i.e. 03/08/2015
or should i wait until 21/08/2015 ( as i have come to UK after 18 days of my visa start date).
Dont want too pay the huge visa fee for 2 times ...soo guys can you plese guide me

Actually the 5 years count from the date you have entered the UK(i.e 18/09/2010 - 17/09/2015)

So you will be eligible to apply 28 days before 17/09/2015 which is from 20/08/2015.

As your visa is valid until 31/08/2015, you still have 11 days to apply for your ILR.

You and any dependants applying with you should apply before the end of your/their permitted stay
in the UK.
There is a qualifying period to complete in most of the categories on this form. It runs either from
• the date on which you entered the UK with a visa in the relevant category; or, if you did not
enter the UK with such a visa, from
• the date on which you were first granted permission to remain in the UK in the relevant category.
If you entered the UK with a visa several weeks or more after the date from which it was valid for use,
you may need to apply for an extension of stay to complete the relevant qualifying period.
Please do not apply more than 28 days before completing the qualifying period. If you apply earlier
than that, your application may be refused. If that happens, we will not refund the fee and you will
have to pay again when reapplying.

You can apply within 28 days of visa issue date as you entered the UK within 90 days and can make use of the 90 day concession.

Since you have entered within 90 days of issuance of visa so
Your ILR Qualification Date :- 01/09/2015 - 28 days= Apply After Tuesday, 4 August 2015

From Tuesday, 1 September 2015
Subtracted 28 days
Result: Tuesday, 4 August 2015.
