Error made by employer in Tier2

Hi All,

I applied In June 2014
Given biometric in June 2014
Received refusal letter in July 2014
Letter sent to ukba from employer saying the error is made
Reminder letter sent in October 2014
Second reminder sent in January 2015
Still no reply ?? I have not appealed yet.
I called them and they said case worker has not opened the reconsideration application yet.

Any advice on above will be helpful.

so it means u are without a leave at the moment?

Did your refusal give you the right to appeal? If so, you would have had a limited timeframe to do this, which has likely passed already given your regusal was July 2014.

Yes I am without leave to remain, but what can I do I am only waiting for Ukba to update my employer on the reconsideration ,

Yes I cannot appeal now.

Any advice would be really helpful .

You should have appealed when you had the chance as you would have been covered until the end of the process etc.

i personally think that any new application you put in, it will be rejected since you have been here with expired leave.
Best way forward is to go home and apply again for tier 2.
Since u never got a tier 2, you do not have to serve a cooling off period.

Thanks for your reply.

I cannot go home as my passport is with Ukba.

And I have to wait for their decision, they might give me visa after reconsideration of application made by my employer.
