Spouse ICT TIER 2 to ILR DEPENDENT ?

Hello all,

I am currently on my tier 1 extension which is valid till oct 2016. I am eligible for my ilr and planning to apply next month. My husband was working in UK in ICT Tier 2 visa since 2011. We got married last year in oct 2014, but he continued to work in his own visa. His visa is expiring in July and no possibility to extend from his company. In this situation I want to change his visa status. What is the easy and possible way to change his visa status to make my dependent

1) changing his ICT tier 2 to my tier 1 dependent
2) completing my ilr application and then apply for my husband ilr dependent visa

Could anyone please share info on this?

Why would you want to do Tier 1 dep first? Have you looked at the high cost of this visa plus the NHS surcharge on top of that.

It would make sense for you to apply for ILR in person at a premium service centre, get approval on the same day and then apply for your husbands spouse visa on FLR(M).

Switching visas though will reset his clock for ILR and he will have to wait a further 5 years before he can apply for ILR.

NHS Surcharge is also applicable for FLR(M) - £500 payable upfront at point of application.

Thanks for your reply.

I have one more question. As My husband is on ICT TIER 2 , He might need to go India this month as his Company changing his location. Can He apply FLR(m) from India?

Also I believe switching to flr-m He Will have The same Job right as Mine. Could You Please confirm?

If he applies from home country it is VAF4A and Appendix FM he needs to complete and it takes longer.

Have you looked at the FLR(M) form to see all the documentary evidence you need to provide.

It will most likely be easier and quicker if he switches in the UK to FLR(M) once you have been granted ILR. He will be free to work for any employer once he switches.

Both ILR and FLR(M) applications can be made in person using premium service centre.

Hello,

Thanks a lot for all the information given to me earlier.

I had applied ILR and that has been granted two weeks back. My husband who is on ICT Tier2 visa wants to apply as my dependent now. So I believe the only route is to apply in FLR (M) category which will reset his ILR clock.
Could anyone please let me know below informations regarding FLR(M) :

1) if his ilr clock resets , whether he will be able to apply ilr after 5 years from now provided ilr application going to be stopped in 2018?

2) Could anyone give the link for FLR(M) doc list ?

3) Is letter from university detailing the last degree was taught in English sufficient to get points in English language requirement?

Applications for ILR will cease only for Tier 1 General applicants in 2018. Their dependents and all other categories (your husband will be an ILR dependent) will continue to be eligible for ILR.

Assuming that his degree was also on the PBS calculator, it might be.

Thanks for the quick reply. Yes his university in PBS calculator to be very specific in NARIC database, hence letter from university and degree certificate will be submitted as english proof. Correct me if I am wrong.

Also I have another question regarding cohabitation is it mandatory to show documents for last 2 years, if so how they should be distributed?
