Moving to Ireland

Post by Concern » Mon May 04, 2015 6:49 pm

Hey guys,
I need a big advice. I am a non-EA national who married an EA national back in May 2013. I have a RC for 5 years which will expire in 2018. We split 4 months ago and we are not living together anymore.
I have a full time job and getting payslips, have a current account.
He is working cash in hand, not contract for his job, and had a problem with a bank before and has been banned for more than 2 years to open any bank account(not savings, not current nothing)...such a disaster.
I moved on with my life as my marriage was not as I thought. I met a British man who works in Ireland and asked me to go, move, and marry him after my divorce.
My questions are:
1)How long it will take to divorce my ex?
2) Any good solicitor for this?
3) To go to Ireland I will go as a visitor and get married there? or its better to marry in the UK and then move to Ireland?
4)Will I need a visa to go to Ireland if we decide to marry there?
5)Eventually we will move back to England so to get my PR how long should I wait?
6)Does my almost two years marriage with my ex counts towards my PR?or I will loose it?

Thanks for your help in advance!!
:D

Hi Concern,

There are alot of questions there. If the EU citizen is still in the State and is working or studying, you can apply again for EU1 residence card.

Email me at the email address below if you like and i can assist you.

1)How long it will take to divorce my ex? Depends on your circumstances if there are assets, children, etc. and whether or not your spouse objects to the divorce. It can take quite a few months before you get the decree absolute.
2) Any good solicitor for this? You can do it your self but any local solicitor where you live would probably help at a nice fee.
3) To go to Ireland I will go as a visitor and get married there? or its better to marry in the UK and then move to Ireland? What is your nationality?
4)Will I need a visa to go to Ireland if we decide to marry there?Depends on #3 answer
5)Eventually we will move back to England so to get my PR how long should I wait?5 years from date of marriage
6)Does my almost two years marriage with my ex counts towards my PR?or I will loose it?you will lose it

We don't have children or assets we split amicable. I am sure he will still able to help me to stay BUT how can we prove we lived together? One of his mistakes is that he doesn't have bank statements, and his actual job is just cash in hand!! Should i wait until 3 years of marriage, divorce and apply for my PR before moving to Ireland ? I don't want to lose those almost 2 years living and working in England.

Help!!!

You wont get PR. You would be able to apply to retain your rights of residence but would be applicable to staying in the UK, not Ireland.

Any application you make, you will need to prove your current EU husband is exercising treaty rights. I don't know how you can prove that if he gets cash in hand pay.

Thanks CR001!

I think I made my decision now. I will start getting divorce as there is no way my husband would be able to help me to stay because his jobs situation and other than I want to move to Ireland.

Now my new partner -who is British and has a proper job with bank statements, contract, proof of address- wants me to move to Ireland as soon as I divorce but we eventually would like to move back to England when his job contract finishes (in 2 years). So if we got married and I move to Ireland with him I think I will get a stamp
4 EUFAM card right? It will allow me to work during my stay there?
So when we come back to England will my British husband will apply for the surinder singh route to get me back to the UK?
Does two years or anytime I am living in Ireland with him will count to get eventually my PR in the UK?

Thanks!! :D
