Of course she can switch to spouse of settlement visa, it is your choice. However it will reset her ILR clock to zero and she will have to wait a further 5 years in that category before she can apply for ILR. It also includes 1 extension as it is initially a 2.5 year visa. NHS surcharge payable for initial application and extension.she can wait till expiry of the current Tier 1 dependent visa and renew it Jan/Feb2017 ?

1. what will be the best time to apply The choice is yours, either pbs dep extension or switch to FLR(M) which will reset her clock to qualify for ILR
2. which form she has to fill PBS Dep or FLR(M), whichever you choose to do.
3. and will she give NHS surcharge fees too? Yes, payable for whichever one you choose. She is not exempt.
