Hi all. I am in a disturbing situation and I would appreciate if there is an unfortunate Soul who is been or is in the same strange and bizarre situation can comment and give me advice.
My situation is this:
We applied for my husband's spouse visa in October 2014 and I am his sponsor. the visa was refused on 9th of December 2014 and we appealing January 11th. The reason for the refusal was that the ECO concluded that our relationship is not genuine and subsiding even though we have submitted our child's birth certificatE. we got appeal pending notice and we'll hear from them on 8th of June.
But MY PROBLEM is this;
While we are waiting to hear from our appeal process, my husband has illegally immigrated in Italy and I am shocked and confused as to what to do with the appeal.
My question is if the appeal is successful, can he submit his passport in Italy or does he have to have legal status in that country? Will it be easy for my husband to go back to his country of origin?

It is highly likely that he will need to submit his passport to the office where the application was submitted. As he has no legal status in Italy so would definitely have a problem.

If he goes back to his home country, wouldn't he be cought while exiting the country? And I am really confused on what to do!

I cannot comment on what other countries will do given that your spouse entered illegally but obviously the risk is high. How did he enter Italy?

he entered by boat from Libya. That is even more devistating.

He really has put himself into a very difficult position. I really hope for your sake that this does not put the appeal in jeopardy.
If he entered by boat, the Italian authorities will now have his details as they document all illegal immigrants that use this route. He might be better off volunteering to be deported.
What country is he from?
What made him decide to do this? There is no quick and easy way to immigrate to the UK, he should know that.

Afters so many attempts to come to UK he lost hope that the outcome of the appeal will be the same (refused) so he thought he will take his chances on the seas.
If he decides to volunteer to be deported will they assist him? And would they assist him and how long will it take u think?
