Tier 2 general Spouse Visa 3 year or 5 year?

Post by Tbilisi Married Man » Thu May 07, 2015 5:18 pm

I am a British National looking to return to the UK with my Georgian (outside the EU) wife. As I understand it is not yet possible to apply for ILR, but instead we should apply for a Tier 2 General Visa for Spouse (3 year or 5 year).

My question is this - what is the difference between the 3 year and 5 year General Partner visas?

Presumably it makes a difference to the application process but I can't see how from the UK visa website.

Thank you for your help.

If she is returning as spouse of British Citizen, then it is a spouse visa she needs to apply for.

https://www.gov.uk/join-family-in-uk/overview

She can only apply for a Tier 2 visa if she has an employer who is on the approved list of sponsors who will be sponsoring her visa.

Regardless of which route, qualifying period for ILR is 5 years anyway.

Also be mindful of the financial requirements, which if you've been working abroad might be quite tough.

Thanks a lot for the reply.

Yes, I had already identified that page as the visa we require for her, however, on the immigration health surcharge website this visa type is not obviously categorised. Do you know which 'visa route' and 'visa type' that visa (https://www.gov.uk/join-family-in-uk/overview) falls under?

Thanks again.

Probably listed as 'settlement' or 'spouse' visa

In that case 'Visa route - Settlement' and 'Visa type - Wife'. Does that sound correct?

Thanks.
