Tier 2 General - Dependent Question

Post by CadCad » Tue May 19, 2015 5:27 pm

Hi,

I will be moving from Canada to the UK this summer and my company will be sponsoring me for a Tier 2 General Visa. My wife is also planning on moving, but it is currently unclear as to whether her company will be able to successfully sponsor her for a Visa as part of her move to the UK.

My question is lets assume I am successful in obtaining a Tier 2 General Visa through my company sponsorship but my wife's company is unable to sponsor her (i.e. she doesn't receive a Visa through company sponsorship) - how quickly after receipt of my Tier 2 General Visa must I wait before my wife could apply as a dependent under my Tier 2 General Visa? Additionally, given my company would in theory not be sponsoring her, what form of maintenance and other requirements would I need to provide?

Thank you so much for your help regarding this matter.

She can apply at the same time as you. The details should be in the guidance notes.

She can either apply together with you or later. If she applies the same time as you and your company certifies maintenance for you then she is automatically covered for maintenance. If she applies later she has to show maintenance which can be either a letter from your sponsor certifying maintenance for her or £630 held for 3 months (see link above).

Note that on a PBS dependant visa she is free to take any employment in the UK (except as doctor in training), i.e. she might as well apply with you and once she is in the UK she can start work straight away.
