Earliest date for appearing for ILR

Hi,

My Tier1 visa started from 28th June 2010 valid until 28th June 3013
I entered to UK on 17th August 2010 (nearly some 49 days gap)
After extension i got another 3 years visa which is valid until 19 August 2016

My doubt is from which date i am eligible for appearing for ILR?

Some friends says as my stay in India was only 49days which is within 90 days, i can go 28 days before my visa start date (which is 28 days before 28th-June-2015)
Some friends says i can go only 28 days before my actual entry date (which is 28 days before 17th Aug 2015)

Please help with your experience in this case.
