advice please - which visa?

Hello

I am after some advice please. My partner and I have been together for 2 years, living together 18 months. We have talked about getting married soon, but haven't set a date.

His visa is due to expire soon. Our solicitor has suggested we do the FLR (M) as an unmarried partner visa. Would there be an advantage to getting married before the visa is applied for and then apply as married? what are the advantages of doing this?

If he gets his visa this way will it be for 30 months? He is already in the UK, and has been here since 2007. When could he apply for ILR?

You'll need to marry - 18 months in not enough for UPV, 24 months set in stone....

He'd get a 33 month visa, 849 quid I think plus need to pay the £600 NHS surcharge, same again after 30 months. Then ILR after five years.

Do you meet the earnings requirement? £18,600 pa?

Yes, I earn over that. And so does he.

The solicitor is hoping that by the time the visa is done we will have passed the 2 years living together, but I don't want to risk it.

Wanderer, for in country FLR(M), it is a 30 month visa that is issued.

He is already in the UK, and has been here since 2007. When could he apply for ILR?
If he applies and is successful with FLR(M), he will qualify in 2017 on the basis of 10 years long residence for ILR.

When exactly does his visa expire? You would need to give at least 28 days notice of marriage at one of the approved UKVI registrar offices. It is likely to be extended to 70 days as the registrar has to inform UKVI of a foreigner marriage notification.

Sorry, I was dithering about the 30/33 month thing and went the wrong way! Kind of knew there's no point in three months travel grace for an in-country.....

I'm old enough to remember the cane - I got 10 strokes for spitting on someone at school in 1969, I've no idea why I did it, odd really because I think spitting is disgusting. Bloody paid for it though, with a mega sore arse.

That, and 50 lines 'I must not forget my PE kit' - easy, did the lines at break, and 500 lines 'I must not talk in assembly' which was grossly unfair as I wasn't even talking, it was the others! - that took ages to write out and then the teacher just tore them up in front of me.

Added to that a policeman took my name for borrowing i.e. stealing wood for our bonfire in 1967, even now when I see a policeman I'm convinced he's 'got my number' and knows I was a notorious six-year old wood thieving super-criminal in Bolton.

That's my concern. He is hoping that by the time the case is reviewed we will meet the 2 year requirement. He put in an application last June, which was denied, and that wasn't heard until December. But This time we are hoping it will take 6 months to be heard, to get us past the 2 year cut off....

Plus he is applying for Private Life, as he has been here for so long, with family, friends, mortgage, and me!

I just would rather it be more certain to get a visa, like a marriage one.
But I don't want to get married, just for a visa, if there is another option. I don't know if I am explaining myself well enough. :?:
