Urgent Help: Salary on CoS

Post by hammjav » Mon Jun 15, 2015 6:45 pm

Hi

I am applying for Tier 2 under "3538 Financial accounts managers" (Salary rates: New entrant: £22,200 / Experienced: £27,500)
As I am 24 years old my sponsor has offered me salary of £24,000 on CoS as a new entrant and the start date 01/08/2015 to end date 31/07/2020 (5 years).

I showed my CoS to one of my friends who is already on Tier 2 he told me that as the CoS is for more than 3 years my sponsor should pay and mention experienced salary on CoS i.e. minimum £27,500. Is that right?

If that the case how can we make changes on the CoS and also the RLMT was conducted on the basis of £24,000.

I was in UK since august 2009 on Tier 4 visa and I passed my MBA degree in july 2014 and I was offered a job, everything went well until my prospective employer failed to obtain COS because the COS allocation request was not done properly. As my Ter 4 visa was expiring in January 2015 I was advised by some consultant to make a holding application (EEA2) to maintain my lawful status in UK and to buy sometime for COS allocation to come through.

Thank you for reply manci, your urgent response will help a lot.

if you are a family member if an EEA national exercising treaty rights in the UK you don't need a CoS.

NO that's the problem I was misguided by some consultant into putting EEA2 application to buy sometime until my COS allocation comes through. Now I understand that was a huge mistake but at that point I didn't even knew what it was.

I have consulted few solicitors and they say this practice is very common and it shouldn't be a problem to vary application to Tier 2.

Now my employer wants to make the necessary change in CoS and the submitted the application today.

@manci - the OP is not an EEA citizen or a EEA family member. OPs partner is British. See this thread

It is actually NOT very common, so you have been ill informed. As Greenie advised in your other post, you cannot vary and EEA2 application to a Tier 2 General.
