Fiance visa to Spouse Visa - A Few Questions

Post by Cit2016 » Fri Jun 26, 2015 10:40 pm

I am in UK on ILR (converted from Tier1Genaral to ILR).

Mt fiancé lives outside UK. She will apply for fiancé visa for 6 months. Once we are married in UK, which visa will she apply to remain in UK?

I read on gov.uk that she will need to apply as dependent of Tier1General, because I came to UK on T1G and then settled. Is this true? Below is the link:

Job requirement for Sponsor

Post by Cit2016 » Fri Jun 26, 2015 10:42 pm

If I sponsor my fiancé to UK and then she will apply to extend visa, does this require me to be employed? I am not employed but have enough savings (in 6 figures).

£62500, letter from bank is ok?

Post by Cit2016 » Fri Jun 26, 2015 10:51 pm

To sponsor my spouse to come to UK, I will use cash savings of £62500, but the bank doesn't provide monthly statements for savings account. Is it ok if I take a letter from bank stating that I have £62500 in the account? Or does it need to be statements?

As far as I am aware, it is 6 months statements.

No, if she has not been in the UK as your Tier 1 dependent, she cannot apply in that category. She needs to apply for FLR(M) (Click) once you are married and before her fiance visa expires.

Not if you are relying on savings.

Gov.uk says: If your partner was in the UK on a temporary visa before settling or becoming a British citizen, you may have to apply as a ‘dependant’ (partner) in their original visa category.

Thanks for you answer, but I am still doubtful with the wordings on Gov.uk website

Was she previously in the UK as your Tier 1 Dependent?

If the answer is NO, then what you are quoting is not relevant to your fiance.

As you are settled (ILR) and she is applying for entry clearance as your fiance, which is part of the settlement/spouse visa category, i.e. to get married in the UK, she then only has the option to switch to FLR(M).
