All,

Thanks for reading my post.

I have a situation where i require Tier2 extension for 7 months to get myself ILR on 10 years route.

My sponsor is happy to extend and provide me COS. My Mrs parents are seriously ill (One having cancer and other alzheimer). I had two kids in the since my marriage back in 2011 and since then i couldn't visit my home country. One reason was that i didn't want to apply for my kids visa as i wanted to complete my 10 years period and get them the passport once i have ILR due to my financial circumstances.

Question: Can i apply 7 months early ILR on compessionate basis, that my In law are seriously ill and we as a family need to pay them a visit.
With COSS attached with ILR application which reflects that i still can hget Tier 2 extention but to save myself the application fee, i am applying for ILR.

Unlikely and probably not possible considering that you are able to extend Tier 2 visa to meet the requirements.

What visa does your spouse have?

my wife is my dependent (Tier 2). I know she can travel back but i have two kids whose visa i havnt applied in lieu of the the fact i requried another tier 2 extension. Eventually saving myself another 2500 pounds.

also do i need to do life in uk test for ILR.

Yes, you need Life in the UK test and you need to meet the English B1 requirement.

Your children, if UK born, won't qualify for a passport directly as they are not British. You will need to register them first on MN1 and pay the £749 fee each and once you receive their registration certificate, apply for the passport.

You will still have a problem in regards to your children traveling. How will they re-enter the UK if they do not have a visa?

I am aware o fthe fact that they willl not be able to make in once left the country. All I was after a way to apply ILR 7 months early on compassionate grounds.

Change in situation now:

Apparantly my sponsor has run out of allocated quota of Tier 2 sponsorship and in the process to increase its quota. how long does it take for UKBA to extend the quota given that my Tier 2 visa expires in 2 and half months.

if in case my sponsor would struggle to get extended quota, would i be able to apply for my ILR which is 7 months away?
