1st application for leave to remain

Hi,

I wonder if someone could assist me with a couple of pointers. My partner and I are now married and are filling in the 'FLRM 04/2015' application form.

1. Should my spouse be using her prior surname throughout the application (i.e. the name on her passport). Normally after marriage the bride assumes the surname of the husband but that's not going to match with any of the supporting evidence and documents.

2. My partner has a 22 year old son from a prior marriage who still lives in his home country and is not part of the application as their is no intention for him to join us in the UK. I was therefore a bit surprised to see on page 59 of the application form a requirement to provide his original birth certificate. We do not have this document and a check of the government website states it could take six to eight weeks to request a new copy. At short notice we can get hold (from family members) of a scan of a document from the registrar's office but that' about it. Is this likely to cause problems with our application?

1. Is she applying for FLR(M) after being on a Fiance Visa? If yes, then it should be fine re surname as the fiance visa is for getting married in the UK.

2. Her childs birth certificate is NOT required as he is not applying for anything. The page/point you refer to is for if a child is applying as a dependent with the parent.

Thanks for your quick response.

1. Yes she is applying after being on a fiance visa. So are you saying that she should use her old surname (which matches supporting documents, e.g. passport, correspondence) or her new married surname?

2. Your comment is encouraging but the exact wording within the application is as follows, and I've put in bold the bit that's causing a bit of concern. "An original full birth certificate i.e. one which shows the parents’ names for each of your children. This includes children applying for an extension of stay in the UK with you, as well as children not applying with you and those not subject to immigration control.

2. The wording is slightly confusing, but it only applies to either children applying with her for leave to remain or British children who are free from immigration control who are not applying as they do not require leave to remain. It is NOT applicable to her adult child in another country and who is not British.
