Tier 2 ICT to ILR - Main Applicant and Dependent

Hi there,

I am currently in UK on Tier 2 ICT since 2010 and applying for ILR next month.

My Wife is in UK since July 2015 on Tier 2 ICT staff dependent and her VISA is valid till Jan 2016.

When I covert my VISA into ILR, what will happen to her Tier 2 ICT staff dependent VISA? Will her Tier 2 ICT staff dependent VISA still be valid till Jan 2016? or Do I need to apply FLR(M) for her along with my ILR?

On what date in 2010 did you apply and receive your visa?

If you qualify for ILR, then your spouse can continue to extend her current visa on the PBS Dependent form until she meets the requirements for ILR. She should apply to extend her current visa shortly before it expires. If she stays on her current Tier 2 ICT dep visa, she is exempt from the IHS Surcharge of £200 per year.
Do I need to apply FLR(M) for her along with my ILR?
No, you don't. If she switches to FLR(M) once you get ILR, she will have to pay the IHS Surcharge and it will be £500 for the initial 2.5 year visa. Switching will also reset her clock to zero.

If you apply for (and are granted) settlement as a PBS migrant, your spouse can continue to extend her leave as a PBS dependant until she qualifies for settlement.

No need to switch to FLR(M), as already mentioned above, unless she is a doctor / dentist.
