EEA family permit delay

Post by Melanie88 » Tue Jul 28, 2015 8:37 am

My husband and I applied for an EEA family permit 8 weeks ago. After a week we received an email that our application was not straightforward and it might take longer than 15 days but that we will hear from them within these 15 days.

We never heard back from them and we still haven't received an answer after 8 weeks. We sent emails and call the helpline but no one is given us any information on what's going on. What can we do?

Thanks for your help

Hi Chaoclive,

I have a similar situation like Melanie and was hoping you can send me some information as well since you did not post it online and sent her a private message.

I am a German national living in London for past 10 years, I completed my degree here and now have been working in the same company for past 9 years with an above average salary.

I married my husband a Pakistani national in June 2015 in Pakistan, due to our culture this was an arranged marriage, we had contact before but we never lived together.

Only few days after our wedding my husband applied for the EEA family permit but it was refused as we did not prove that I was in the country for the wedding and we also did not submit any email conversations etc. and the case officer was not satisfied that this marriage was not a marriage of convenience. We were given the choice to appeal or to reapply if we feel we can give more evidence which we obviously could including: Marriage Certificate, pictures of wedding and post wedding pictures, chat copies and email copies between the two of us...

We did re-apply on 16 July 2015 and on the 7 August after around 15 working days my husband got an email stating that his application is under consideration and 'Unfortunately, the processing of your application has been delayed while we undertake further checks.'.

Myself and him have contacted the customer service on a weekly basis and always were told that our application is being processed without any indication what exactly is happening and when we may expect a decision, today is the 32nd day after application and I dont know anymore what to do and who to contact.

Can you or someone else give me any guidance please?

No, he did not do any exam - it is not an requirement for the EEA family permit and he is applying for a visa for the first time.
