Understanding Joint Claiments When under immigration control

Post by zakir1988 » Mon Aug 03, 2015 10:20 pm

Hi guys

I want to make people aware that when your partner has a visa and on there biometric residence permit card it will say no public fund and also will have a letter saying you cannot get any benefits on behalf of of your partner that would breach her visa conditions.

I made mistake I do not want people making the mistake I made before it's too late. I was getting all benefits under my name since I'm British citizen born and brought up here in London thinking that she's not allowed no benefits since her brp card say no public fund I searched the Internet, forums and government websites saying that Child Tax Credits need to be joint Claiments if other half even is under immgration control others need in your name only.

Don't make it late fix this ASAP if your parent is working who is under immgration control and your claiming as single this is illegal as you would need to phone them and stop the child tax credit and make it joint Claiment as you would maybe have to repay them back all the child tax being overpaid as you did not state your partners details on the form and if one of you who is not under immigration control working then adding your partners name who is under immgration control would not effect nothing as you will get the same ammout.

I have found out about mine they said adding my partner who is under immigration control is not a problem and told me that I would get the same money that I'm receiving if my wife was working I did not state that I would of being in trouble and will have to repay the overpaid child tax credit.

Can someone tell me I'm adding my wife's name on the child tax credit when I get the form I was claiming child tax credit just under my name but would this jeopardise her visa when I come to extend her visa I was claiming everything under my name because she did not have a visa at the time she was reporting to immgration every 2 weeks signing on then we applied for flr fp then she got the visa under 10 year route parent and then I was after getting her visa I was still claiming under my name only when I saw her brp card say no public fund thinking that she is not allowed nothing then I found out child tax credits nee to be joint Claiment even under immigration control.

Please do make the mistake do your research on the Internet.

Can some answer my question as above stated thanks

Why are you repeatedly asking the same question and ignoring the advice given?

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.
