ILR for wife while I'm getting Child Benefit

Post by srk2012 » Tue Aug 04, 2015 10:02 pm

Hi, I got my ILR in March 2013. My wife was my Tier 2 dependent till then. She got an extension for 2.5 years thro' FLR (m). She is planning to apply for ILR now. I have been getting child benefit (on my name only) since August 2014.

Will this affect her ILR?
Should we mention in her ILR application that I'm receiving child benefit?

We both are working full time and are higher rate tax payers. Please do help.

You're entitled to claim child benefit in your name and it won't affect your wife's ILR application.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

Should I mention in her ILR application form that I'm getting child benefit or can I leave it blank?

You need to tick the relevant box under 'Your Partner' on page 23 of the Set(M) Form (click)

Do not leave it blank, they have access to check the benefits system with DWP and HMRC.
