Tier 2 Dependant Extension

Post by sumlak » Wed Aug 05, 2015 4:41 pm

Hi,

I am on a Tier 2 General visa valid until July 2017. I've been on Tier 2 General since 2012 but have changed 2 job whilst in this category. My Wife is a Dependent on my visa since Jan 2013 and had recently got her extension until July 2017. I have a few questions regarding my application and my wife's dependant visa and I'd appreciate if some one can help.

I will be due to apply for my ILR in April 2017 and until then, my wife won't be eligible to apply for ILR till then under the new 5 year rule. What options do I have to extend my wife's visa?

I've read that she can apply for a Dependent of a Settled person however in that case; her ILR clock will reset and she will have to built the 5 years history again? Another option, I read was to get her visa extended for another year as Tier 2 Dependent Partner but how can she apply to extend her visa in this category when I won't be on this category after my ILR application? Is it still legitimate to extend her visa on same category when I am out of this category?

Another question I have is for my own visa - Does it matter how many times you change jobs on Tier 2? Does it reset the ILR clock if I change jobs but remain in the same category?

Any help on this will be greatly appreciated.

Many Thanks!

If you obtain ILR based on Tier 2, your spouse can continue to extend her visa on the PBS Dependent form until she meets the 5 year residence requirement. The rules permit this only if you apply on 5 years residence as main Tier 2 applicant for ILR.

Switching to spouse of ILR holder visa will reset her clock and she will have to wait another 5 years in this category before being eligible for ILR.

Advice based on the rules as they are at present.
