Visa can issued for up to 3 years or till 5 years depending on the start and end dates on CoS. Once 5 years is completed she can apply for PR/ILR

You can continue on your ICT short term visa and once your wife gets the Tier 2 general visa, apply in-country to switch from ICT main applicant to T2 General dependent. Cooling period will not apply in this case

switching from T2 ICT ST to T2 General Dependant

Post by ttyr » Tue Sep 01, 2015 12:25 pm

Hi Friends , I have few doubts , please clear

I am in ICT TIER2 Short term visa.
My wife who is my dependant got a job and she is applying for T2 General visa next month
As my visa expires on Jan , i am planning to switch to General dependant visa along with her application

Is it possible to switch to dependant and can i continue to work with my current employer ?

Should i notify them that i am switching to dependant visa ?

Switching to PBS dependent route
You must, once your application has been approved.

will i be eligible to appy for t2 general visa again
since i am in ict short term at the moment , is there any cooling period i have to wait for

You may choose to tell your employer that you are switching, but I would suggest that you do after you have switched. Either way, you must inform the employer that you will not be needing / do no longer need sponsorship.

What do you mean directly sponsor you? Is there a indirect sponsorship also?

Yes, you may change from PBS dependant to Tier 2 (General) but for this you will need a rCoS and you will need to apply for such change from outside the UK.

Dependants are not subject to cooling-off period, provided the dependant has not been in the UK as a Tier 2 migrant in the 12 months preceding the entry clearance application.

many thanks for reply
what i meant is
1 . as you said i can switch from ict 2 to T2General Dependant

I heard there can be rule changed next year where UKBA is thinking of not allowing Dependants to work or
minimize the number of hours

My question is if i get T2DEPENDANT visa and after few months if i get a sponsor
can i switch to T2 GENERAL with the new sponsorship?
Can i do it from UK or have to do from my native country
