Divorce after three years of marriage

Post by Ishika kohli » Mon Aug 17, 2015 8:55 am

Hi
I m an Indian married to UK citizen . it's been three years of our marriage BT I m not happy as s I don't love my husband n he knows . my question is can I divorce my husband and request for UK visa . I read somewhere that If marriage has lasted for three years then I can request for single visa but I have confusion because the marriage is three old years BT I have lived only for 2 and half years in UK .
Does it still valid to apply for UK visa after divorce

As I see it from what you've posted, as you are sill on limited leave to remain you cannot apply for indefinite since your marriage is not subsisting. Assuming no kids your only option if LTR based on your own merits, i.e. student visa, Tier 2 Work Permit etc.

So no 'magic visa' I'm afraid....

No, you'd need to find a Tier 2 sponsor to apply for a work permit for you, you can't apply for it yourself.

I read somewhere that If marriage has lasted for three years then I can request for single visa
What you are referring to here is the issue relating to spouses of EU citizens. It does not apply to spouse of British citizen. So as Wanderer has said, you will need to find a sponsor, from the approved sponsor list, who will be willing to sponsor you if you want to switch to a work visa (Tier 2). Minimum salary for this category from next year April is £35,000 per annum to qualify.
