Likelihood of application for extension being refused

Post by jyanyxq » Sat Aug 22, 2015 10:10 am

Hello, thanks in advance for those who replied.

I am working under Tier 2 General visa (issued two years ago). Last week, I got a new job offer from a different employer who would like to sponsor my Tier 2 General visa. The new employer wanted me to start work as early as possible. I know it is not a good idea to resign from current company without receiving the new visa. Just wonder how risky if I do so, i.e. how likely my visa extension application will be refused by UK Home office. Is there any preventative measures I can take to mitigate the risk? Thanks for sharing your experience or insight! Kind regards, Lee.

About 5 years continuous residence Tier 2 & Extension

Post by jyanyxq » Sat Aug 22, 2015 10:40 am

Hello, thanks in advance for those who replied.

I have a question in relation to 5 years residence requirement for permanent resident application.

I got my Tier 2 General work visa on 1st Nov 2013. Now, I am changing company and my new employer is processing the visa sponsoring things. Once it is done (likely in one week or so), I will apply for visa extension (for the 3 years one). My question is, if everything goes well and I got my new visa, for example, on 15th Oct 2015. would my case meet 5 years requirement for permanent resident application? Given the new visa being issued on 15th Oct 2015 for example, it will expire in Oct 2018 or even earlier. That is less than 5 years if counted from 1st Nov 2013 when my first work visa was issued. Does this one month or so gap matter?

To be safe, shall I apply for extension for the "more than 3 years" option instead, although the latter about £500 more? Thanks for sharing your experience and insight. Kind regards, Lee.

salary listed in the Codes of Practice

Post by jyanyxq » Sat Aug 22, 2015 11:12 am

Hello, thanks in advance for those who replied.

I have a question regarding the salary requirement for eligibility of permanent residence application.

On UK Home office website, it says "you get paid the relevant salary listed in the Codes of Practice". When I looked at "Codes of Practice for Skilled Workers, Standard Occupational Classification (SOC) Codes and minimum appropriate salary rates" PDF, there are two salary rates under each job code, the new entrant and experienced. Does anyone know which rate is to be applied when your eligibility is reviewed? Thanks and kind regards!

I have merged your two posts into one thread and moved it to the Tier 2 forum, which is more appropriate than the ILR forum.
