People are only considered settled if they are British Citizens , have Indefinite leave to remain, or Permanent Residence under the EEA Regulations.
Your husband does not appear to fall into any of the 3 categories that I listed above.
He married to an EEA national and they have a son. They are now divorced. The visa he got is on the basis of his son and not his ex wife as both the son and father are in contact and in good relationship. Lol this has been really complicated and we thought the same.. But after a certain period, he is allowed to have permanent residence under eu law.. At the moment, as my visa is going to get expired, we wanted to know every possible way that could convert me or make me his dependent.. So now what u suggest?? Am i eligible?? As things stand you may only be entitled to apply under FLR(FP) outside the rules, as you do fall within it.
If I understand his position better, then you may have greater rights, but I am yet to establish this.
His position under EU law is puzzling for me.
FLR(FP) is not issued under EU law but under the Immigration rules. It makes no sense for a person who qualifies under EU law, to apply under Immigration Rules.
