As im not too active on this forum, moderators please feel free to put my post anywhere u think I can get maximum responses from.

My husband holds flr(fp) visa. Im already in UK but I came here as a student (because at the time i came here his visa application was in process).

Question is, now my student visa is about to expire and since my husband is considered as a settled person in UK, can I apply as his dependent?? We have two babies too.

If im eligible, can please anyone guide me what documents does my husband need to show?? Basically Im more interested to know if he has to show his bank account details??, pay slips or not?? If yes, how much amount??

I will appreciate the quick responses as my visa is going to expire in a months time and we have to take a quick decision.

If you husband has FLR (FP), then he is not settled .

On what basis did he get it?

People are only considered settled if they are British Citizens , have Indefinite leave to remain, or Permanent Residence under the EEA Regulations.

Your husband does not appear to fall into any of the 3 categories that I listed above.

He got his visa on basis of his son (from his ex wife) and who is an EEA national.

So u mean actually I can't apply as his dependent?? And what should i do to remain here apart from applying for the extension of my student visa.

Was the EEA national Exercising treaty rights, and if so for how long?

How long did their marriage take before it ended, and where they living in the UK during this period?

What is the nationality of this child , on the basis of whom, you husband had his visa?

He married to an EEA national and they have a son. They are now divorced. The visa he got is on the basis of his son and not his ex wife as both the son and father are in contact and in good relationship. They lived in uk all this time and his 16 year old son is living in UK almost since he was born.
So my husband has flr(fp) visa in his son's basis.

Lol this has been really complicated and we thought the same.. But after a certain period, he is allowed to have permanent residence under eu law.. At the moment, as my visa is going to get expired, we wanted to know every possible way that could convert me or make me his dependent.. So now what u suggest?? Am i eligible?? If yes, then please reread the firat post and reply :)

As things stand you may only be entitled to apply under FLR(FP) outside the rules, as you do fall within it.

If I understand his position better, then you may have greater rights, but I am yet to establish this.

His position under EU law is puzzling for me.

FLR(FP) is not issued under EU law but under the Immigration rules. It makes no sense for a person who qualifies under EU law, to apply under Immigration Rules.

He is on flr(fp) 10 year route.. Does that make sense?? Or prolly im missing here something too :(

If he had not fallen under right application, why would he be granted the visa at the first place??

British citizens are EEA nstional also .

That is why i ask what nationality. Eea national is not a nationality.
